Bridge Pilates, and its owners employees, independent contractors, instructors/teachers, (current and past), suppliers, distributors, , individually and collectively entities (collectively, “Bridge Pilates” also referred to herein as “we,” “us” and “our”) provides website features and other products and services (“Services) to you when you visit www.blossompilates.com and other websites or software which currently exist or may exist or be created by us in the future (the “Site”). 

Your viewing and use of our Site and utilizing our Services are conditioned on, governed by and subject to the  provisions set forth below (the “Provisions”).  If you access our Site, you are agreeing to the Provisions; if you do not agree, please discontinue using our Site immediately. These Provisions are a legal agreement between you and Bridge Pilates and contain important information regarding your legal rights, remedies and obligations. By your use of the Site and our Services, you: (a) acknowledge you have read, understand, and agree to be bound by these provisions; and (b) represent you are an adult at least eighteen (18) years of age and have the legal capacity to enter into contracts in the jurisdiction where you reside.

By using this Site and our Services, you acknowledge that You understand that physical exercise can be strenuous and can expose you to the risk of serious injury. We urge you to obtain a physical examination from a doctor before participating in any exercise activity. You voluntarily accept and assume any and all risks, known or unknown, associated with Your Use of the Site and our Services including, without limitation, the risk of physical or mental or emotional injury, minor and/or severe bodily harm, death, and/or illness, which arise by any means, including, without limitation: acts, omissions, recommendations or advice given by us.

You also acknowledge that You understand that Bridge Pilates is not giving any personal or medical advice and makes no claims, representations or guarantees about specific results from Your use of the Site or Our Services.  You understand that you have the right to choose what, if any, exercises you perform.

UNDER NO CIRCUMSTANCES, INCLUDING ANY BREACH OF CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ARISING UNDER ANY OTHER LEGAL OR EQUITABLE THEORY WILL BRIDGE PILATES BE LIABLE FOR ANY DIRECT, INDIRECT, STATUTORY, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT MAY ARISE OUT OF OR IN CONNECTION WITH THE USE OF THE SITE OR THE SERVICES.  BY AGREEING TO AND ACCEPTING THESE PROVISIONS, YOU HEREBY IRREVOCABLY RELEASE BRIDGE PILATES (AS DEFINED ABOVE) FROM LIABILITY OF ANY KIND, AND FOR ANY CONSEQUENCE(S) ARISING FROM THE USE OF THE SITE AND THE SERVICES. THIS INVOLVES ANY AND ALL LOSSES, INCLUDING BUT NOT LIMITED TO, MEDICAL EXPENSES, PROPERTY DAMAGE, LOSS OF PROFIT, DAMAGE TO REPUTATION, FEES, ACTUAL ATTORNEYS’ FEES AND COSTS, EXPENSES OR ANY DAMAGE, WHETHER DIRECT OR INDIRECT, WHETHER FINANCIAL OR NON-FINANCIAL.

Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimers may not apply to you.  Some states or jurisdictions do not allow the exclusion or limitation of consequential or incidental damages and, in such states or jurisdictions, our liability shall be limited to the fullest extent permitted by law.

To the fullest extent permitted by law, you release Bridge Pilates, as defined above, from any and all responsibility, liability, claims, demands, actions, judgments, costs, expenses and/or damages (direct, indirect, incidental, punitive, statutory, exemplary, special or consequential) of every kind and nature, known and unknown, arising out of or in any way connected with the following: injury, loss, death, or damage to Your person or property in connection with any use of the Site and/or Services.  This release is to be binding on Your, Your heirs, executors, administrators and assigns.  

Any disputes relating to these Provisions will be governed by the laws of New York State and the United States of America (with respect to matters subject to federal jurisdiction such as copyright), without regard to principles of conflicts of law. The Uniform Commercial Code, the Uniform Computer Information Transaction Act, and the United Nations Convention of Controls for International Sale of Goods shall not apply.

Any litigation (except for small-claims court actions) shall be commenced only in the federal or state courts located in New York County, New York. You hereby irrevocably consent to the exclusive jurisdiction of those courts for such purposes and, to the extent permitted by law, both Bridge Pilates and You WAIVE ANY RIGHT TO A TRIAL BY JURY in such an action.
